TERMS & CONDITIONS — THE BLACK SECRET LLC

These Terms & Conditions (“Terms”) govern the use of this website (https://www.theblacksecretllc.com) and all services provided by The Black Secret LLC (“we”, “us”, “our”), including mobile and virtual personal training, wellness coaching, fitness assessments, and related services. By accessing this website, purchasing services, or participating in our programs, you (“Client”, “you”, or “user”) agree to be bound by these Terms.

Use of Services and Eligibility

To access and use our website and services, you must:

  • Be at least 18 years of age or the legal age of majority in your jurisdiction.

  • Possess the legal authority to enter into this agreement.

  • Not be prohibited by law from using the services offered.

Minors under 13 are not permitted to use the site or services unless verifiable parental consent is obtained in accordance with U.S. law and applicable Washington State privacy regulations.

 

Services Provided

We provide:

  • Mobile, in-person personal training sessions at your home or approved location.

  • Virtual training sessions via video conferencing platforms.

  • Wellness coaching, fitness assessments, and performance tracking.

Sessions are subject to availability and may be affected by trainer schedules, weather, safety, or travel distance.

 

Payment, Billing, and Session Use

Monthly Memberships (“Use It or Lose It”)

  • Session credits renew monthly.

  • Unused sessions do not roll over to the next month and are forfeited at the end of the billing cycle.

6-Month Commitment Package

  • All purchased sessions must be used within the 6-month period.

  • Unused sessions at the end of the term are forfeited.

  • Refunds are not issued for unused sessions.

  • 6-Month Results Guarantee: If you consistently complete a minimum of 2 sessions per week and follow the provided nutrition guidance, you are guaranteed to see measurable results in one or more of the following areas:

    • Fat loss or improved body measurements

    • Increased strength (able to lift more reps/weight than at initial assessment)

    • Improved flexibility and mobility

    • Enhanced energy or quality of sleep

    • Correction of overactive/underactive muscles identified in your initial assessment

  • Progress is measured against your initial fitness assessment conducted at the start of your 6-month commitment.

 

Non-Refundable Payments

All payments, deposits, and session fees are non-refundable except where required by Washington State law (e.g., fraudulent charges, billing errors, or statutory consumer rights).

Cancellation, Rescheduling, and Trainer Emergencies

Client Cancellation

  • Cancellations or rescheduling require a minimum of 12–24 hours’ notice.

  • Late cancellations or no-shows result in loss of the session.

Trainer Cancellation

  • In cases of emergency, accidents, or unavoidable events (car issues, family emergencies, unsafe conditions), we may cancel sessions.

  • Sessions canceled by The Black Secret LLC or trainers will not be lost and will be rescheduled at no extra charge.

Delays

  • If a trainer is delayed due to travel or mobile-training complications, the full session time will still be honored.

 

Health, Safety, and Client Responsibility

  • Clients must disclose medical conditions, injuries, or limitations.

  • We may request physician clearance if required under WA law.

  • Participation is voluntary and at your own risk.

  • We may refuse service if conditions are unsafe (environmental hazards, aggressive animals, etc.).

 

Intellectual Property

  • All content, materials, logos, graphics, text, and media on the website are the property of The Black Secret LLC.

  • Users may not copy, reproduce, modify, distribute, or create derivative works without written consent.

 

User-Generated Content

  • By uploading content (images, text, videos, or other materials), you confirm you own the rights or have a license to share it.

  • Uploaded content may be publicly visible if posted on community features; you may opt-out at any time.

 

Account Suspension and Termination

  • We may suspend or terminate accounts for violations of these Terms, misuse of services, or illegal activity.

  • Paid subscriptions will not automatically refund for unused portions unless legally required.

 

Indemnification

You agree to indemnify and hold The Black Secret LLC harmless from any claims, losses, liabilities, or expenses arising from your use of the website or services.

 

Limitation of Liability

To the maximum extent allowed by law, The Black Secret LLC is not liable for:

  • Indirect, incidental, special, or consequential damages

  • Loss of profits, data, or other intangible losses

  • Injuries, accidents, or health consequences arising from use of services

This limitation does not apply to gross negligence or unlawful acts that cannot be waived under Washington law.

 

Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on the website with an updated “Last Updated” date. Continued use of the website or services constitutes acceptance of changes.

Promotional Communications

By using our services or providing contact information, you consent to receive emails, text messages, or calls about promotions, services, and updates. You may opt-out at any time.

Governing Law and Dispute Resolution

  • These Terms are governed by the laws of the State of Washington.

  • Disputes will be resolved in the courts of Washington unless arbitration is agreed upon.
